Consumer/Buyer Terms and Conditions of Use
Buy-With-Your-Neighbours is a trading name for Clearinsite Limited, of 1 Deans Lane, Pocklington, York, East Yorkshire, YO42 2PX. In this agreement the following definitions apply: 'We' or 'Us' or
‘Buy-with-your-neighbours means Clearinsite Limited. 'You' or ‘Customer’, means the person whose name and address is stated on the Buyers / Customer Registration Form or Order Form or Quotation Request Form, as the case may be. 'Supplier' means a Broker/Wholesaler/Dealer or other third party registered with, or otherwise used by, Buy-with-your-neighbours for the supply of products. A 'bid' is a quotation by a Supplier.
1. In both our reverse auction and quote system offerings, We operate to an agency model.
This means that We will act as Your agent to locate potential Suppliers for the product You
wish to purchase ('Your requirement'). In our reverse auction system, we act as Your agent
providing the name of Suppliers who have offered the lowest price for a product. We pass on your contact and requirement details to the lowest bidder so they can organize delivery and collect the payment.
2. Any contract for purchase of a Product will be between You and the relevant Supplier. This
means that there are additional terms and conditions governing that contract as each Supplier
will have its own terms and conditions relating to that Product. You should make sure that You
read those terms and conditions, and it is Your responsibility to request a copy of them from
the relevant Supplier. Because the contract for the purchase of the Product is between You
and the Supplier, any queries or concerns relating to the Product should be addressed to them
and not to us. Buy-with-your-neighbours will of course assist You with contacting the Supplier if You wish, but it is not our responsibility to do so. At the time of purchase you will be contacted either verbally or via email to discuss payment and the terms and conditions by the supplier.
3. All prices stated on Our website or communicated directly to You by Buy-with-your-neighbours are prices stated from Suppliers or prices we know were available. We will not be held responsible for any inaccuracies in that pricing information. The prices stated on our website represent the suggested current best Price or lowest winning bid. We are not representing to You that we will be able to procure a Supplier to supply at that price. Unless stated otherwise, prices are stated in UK pounds sterling.
4. None of the information regarding Products or other information posted on our website, nor
any bids which You receive constitutes an offer by Buy-with-your-neighbours to sell any Product. We do not sell products we act as your agents to locate the cheapest supplier.
6. All orders are subject to availability, and delivery dates stated are estimated and approximate.
Subject to clause 9, responsibility for all bids, delivery dates and other information provided
rests with the relevant Supplier and not with Buy-with-your-neighbours.
7. By requesting a quotation in our quote system, You are expressly authorising us to provide Suppliers with Your contact information (including your email address). Suppliers will then contact You directly so that You can enter into a contract to purchase the Product directly with the Supplier. As stated above, the contract is between You and the Supplier (and Buy-with-your-neighbours is not a party thereto).
8. When You place an order in our reverse auction, You are agreeing to purchase the
requested Product at your maximum Price or less. This is a commitment to purchase from
any of our Suppliers win the Reserve Price. If your answer to our access question is not accurate (i.e a normal tanker cannot obtain access) you may be liable to other charges. In extreme weather conditions (snow, frost, wind etc) suppliers may not be able to deliver on the date promised. An alternate delivery date will be arranged by the supplier.
9. We may be liable to You only if a court finds that damage suffered by You has resulted
from (1) our negligence, fraud or willful default in carrying out our duties as Your agent as set
out above, (2) a misrepresentation by Us of important information, or (3) a breach by Us of a
relevant law. In the absence of any of these, you may not claim against Buy-with-your-neighbours (or any officer or employee or duly authorised agent of Buy-with-your-neighbours) to recover any damage suffered in connection with this contract.
10. It is intended that these terms and conditions constitute the entire agreement between Us and You.
11. You undertake to Us that personal and contact details You give Us whilst using Buy-with-your-neighbours's services are correct, and in particular that the credit card or debit card details You are using are Your own and that there are sufficient funds to cover payment of the fee charged by Buy-with-your-neighbours in respect of any membership You make.
12. Any notice served on You in connection with this contract of agency may be served
personally or be left at the latest address given by You in Your Buyers Registration or Order
Form, or may be sent by first class post to such address. Buy-with-your-neighbours will accept service delivered personally or sent by first class post at our registered office. If served by first class post, notices shall be deemed to have been received 2 days after they are postmarked,
13. These terms and conditions shall be governed by English law and the parties submit to
the non-exclusive jurisdiction of the courts of England and Wales.
By placing an order in our reverse auction or by requesting a quotation through our
quote system on our site, you are agreeing to these Terms and Conditions.
Suppliers Terms and Conditions of Use

In this agreement the following definitions apply: 'We' or 'Us' means Buy-with-your-neighbours whose office is at 1 Deans Lane, Pocklington, York, East Yorkshire, YO42 2PX
'You' or 'Supplier' means the Broker/Wholesaler/Dealer and/or third party company(s)
whose name(s) and address(s) were provided on signing up. “Buyer” or “Customer” means the third party whose name(s) and contact details we provide to you for the sale of a
Product/service/product you have given a bid for.
1. We will act as Your selling Agent to refer to you potential buyers for the
Product/service/product You sell. We currently do not charge for supplier membership, however this is subject to change in the future, and commission of sales will be negotiated with each member.
2. We will not be held responsible for any inaccuracies in the quotation you provide
(Including inaccuracies in pricing or errors in our technology).
3. If a bid made by you is accepted, you will receive an email or fax confirming the bid. If you are then out bid you will receive an email or fax informing you of that fact. We can’t take responsibility for that communication being in time for you to rebid to win the auction. Buy-with-your-neighbours will however make every effort to provide the information so you can re bid. If you are the winning bid then you will receive an email or fax confirming you have won the winning price, the delivery day you have stated and all the contact details of every buyer participating in the bid. You will then arrange delivery and collect all moneys due from each buyer. By signing up as a supplier via our website You agree to abide by these terms and conditions.
4. You are required to deliver the products to all the buyers on the day you have stated. However in extreme weather conditions where access is dangerous or impossible, you can contact the buyers and organise and alternative delivery date. You are also expected to log onto the buy-with-your-neighbours website once per week to advertise your latest costs per 1000 litres. Failure to do so will result in removal from membership.
5. Buyers will purchase the Product/service/product from you on your terms and
conditions of sale. You expressly acknowledge that the contract for sale is between You
and the Buyer and that Buy-with-your-neighbours has no responsibility or liability hereunder whatsoever notwithstanding the foregoing, buyers will.
6. These terms and conditions shall be governed by English law and the parties submit to
the exclusive jurisdiction of the courts of England and Wales.
7. We reserve the right to make changes to Our Terms and Conditions at any time.
